The Law for the Enhancement of Labor Law Enforcement, enacted in 2011, aims to improve the enforcement of labor laws and applies to all employers in the market. When a violation of the law is discovered during an inspection by the Ministry of Labor, the employer receives a warning or a financial penalty, and the approval to correct the violations can only be issued by a certified payroll auditor, who serves as a professional authority in this field.
According to the law, clients who hire cleaning and security services and conduct periodic checks through a certified payroll auditor are protected from liability for violations. Without these inspections, the law imposes responsibility on them, even if no direct employment relationship exists with the contractor’s workers.
Additionally, plaintiffs in labor courts are required to attach an expert opinion or calculation of rights, prepared by a certified payroll auditor, to prove non-payment of rights. This service is intended for employees, accountants, and labor law attorneys.
The Ministry of Labor conducts random audits in organizations to ensure that employees’ rights are fully paid. The ministry’s enforcement policy allows for leniency towards employers who comply with legal requirements, including providing proof of correction for any deficiencies found during the wage inspection.
